What Are the Forms of Settlement Mandated under the Amicable Settlement at the Barangay Level

The person is a resident or works in a barangay and is not legally disqualified for any reason and must possess integrity, impartiality, independence of mind, sense of fairness and reputation for integrity may be appointed as a member of the Lupon. Katarungang Pambarangay, or the Barangay Justice System, is a local court system in the Philippines. It is managed by the smallest of the local government units, the barangay, and overseen by the captain of the barangay, the highest elected official of the barangay and its executive. [1] The captain of the barangay sits with other barangay residents at Lupon Tagapamapapa, the committee that decides disputes and other matters. They do not form a court because they do not have judicial powers. [2] The Qatar Pambarangay gang is an amicable dispute resolution system in the barangay. It is an out-of-court resolution of disputes by the members of the community themselves under the direction of the Unong Barangay and without the intervention of lawyers and representatives. Alfredo Flores Tadiar was the principal author of E.O. 1508, the Katarungang Pambarangay Law,[8] and he also drafted its implementing regulations, which required prior arbitration as a condition of judicial review. For 12 years (1980-1992), he was a member of the Consultants Committee, Local Government Supervisory Office, which oversaw the national activities of Katarungang Pambarangay Law.

[7] This is a common event where neighborhood disputes, civil or criminal, outside the jurisdiction of settlement of the Lupon are accepted by the Punong Barangay and even arbitrated by the Pangkat. The Lupon Tagapamayapa is the body that includes the barangay judicial system and includes the barangay captain and 10 to 20 members. [9] The organization is normally incorporated every three years and remains in operation until a new body is established in the third year. Executive Order 1508 speaks of an “unofficial tradition of amicable settlement of disputes between family and barangay members at the barangay level without judicial resources.” [7] According to the revised Communist Party Law, the Lupon consists of the Punong Barangay and ten (10) to twenty (20) members.

Lupine forms every three (3) years. This decree was replaced by the Municipal Code of 1991. Members of Lon shall remain in office until a new Lupon is formed within the third year of their appointment, unless the term of office of one of the Lupon members is terminated earlier by resignation, transfer of residence or place of work, or withdrawal of appointment by the Punong Barangay with the consent of the majority of Lupon members. The basic condition for a local authority to use funds for intelligence or confidential purposes is that it takes into account that peace and order is a priority area of investment in the region and that funds for peace and order programmes and activities are allocated in its total annual funds or budgets.
